Dedicated Cowboy – Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before using the Dedicated Cowboy website (the “Service”) operated by Dedicated Cowboy (“us”, “we”, or “our”). These Terms govern your access to and use of the Service, whether as a visitor, individual user, or business user.

By accessing or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not access or use the Service.

1. Listings

Cowboy Shopper Listings

$3 for a 30-day listing
$25 for a 1-year listing

Cowboy Business Listings

$25 for a 30-day listing
$50 for a for a 1-year listing

All listings must comply with applicable local, state, and federal laws.
Users are solely responsible for the accuracy, legality, and appropriate categorization of their listings.
We reserve the right to remove any listing that violates these Terms or is deemed inappropriate, offensive, misleading, or fraudulent.

2. Business Listings

Businesses using our Service to promote products or services must accurately represent their offerings and hold all necessary licenses or permits required to operate in the State of Texas or any other applicable jurisdiction.
Businesses are responsible for their own customer service, fulfillment, and compliance with consumer protection laws.
Dedicated Cowboy does not guarantee results from any business listing and is not liable for business performance, disputes, or customer satisfaction.

3. Payments

All payments for listing packages are securely processed through Stripe. By purchasing a listing, you agree to Stripe’s terms of service and privacy policy.
You are responsible for any applicable taxes or fees related to your transaction.
Payments are non-refundable, except in the case of:

Duplicate payments,
Technical errors on our platform, or
Listing removals by us due to a violation of our Terms.

4. Transactions and User Responsibility

Dedicated Cowboy is a listing platform only and does not act as an agent, broker, or intermediary for any sale or transaction.
All communications, negotiations, and transactions between users take place independently and at the users’ own risk.
We do not screen, validate, or guarantee buyers or sellers and are not responsible for:

Losses incurred during off-platform transactions,
Fraudulent activity by any user, or
Failure to deliver goods or services.

5. User Conduct

By using the Service, you agree that you will:

Comply with all local, state, and federal laws;
Not post misleading, unlawful, harmful, or infringing content;
Not attempt to access or interfere with the security or functionality of our Service;
Not scrape, crawl, or use automated tools to extract content from the platform.

We reserve the right to suspend or remove any user or listing that violates these conduct rules.

6. Intellectual Property

All content provided on the Service (excluding user-generated listings) is the property of Dedicated Cowboy or its licensors and is protected by copyright, trademark, and other laws.
Users grant us a non-exclusive, royalty-free, worldwide license to use, display, and promote listings submitted to the Service.

7. Limitation of Liability

To the fullest extent permitted by law, Dedicated Cowboy and its affiliates, officers, employees, or partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

Use or inability to use the Service,
Third-party content or behavior,
Errors or inaccuracies in listings,
Unauthorized access to user data.

You agree that your sole remedy for dissatisfaction with the Service is to discontinue its use.

8. Indemnification

You agree to defend, indemnify, and hold harmless Dedicated Cowboy and its affiliates from any claims, liabilities, damages, losses, and expenses arising from:

Your use of the Service,
Your violation of these Terms,

Your violation of any third-party rights or applicable laws.

9. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms, applicable law, or is harmful to other users or our business interests.

All provisions of these Terms that should survive termination (including, without limitation, ownership, disclaimers, indemnity, and liability limitations) shall survive.

10. Modifications to Terms

We may modify these Terms at any time. Material changes will be announced on the platform and, where applicable, via email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Texas.
